Website Terms of Use

Important scope. These Terms govern access to and use of the public BGB-360 website. They do not themselves create a client engagement, professional adviser–client relationship, employment relationship, partnership or entitlement to any service. A signed proposal, engagement letter, statement of work or other written agreement will govern any paid or professional service.

1. Who we are and when these Terms apply

BGB-360 – Business Growth & Beyond (“BGB-360”, “we”, “us” or “our”) provides information concerning business advisory, accounting support, finance operations, outsourcing, ERP and digital support, learning and talent-related solutions. These Terms apply whenever you visit, browse or otherwise use www.bgb-360.com, submit a website enquiry or use a public website feature.

By using the website, you agree to these Terms. If you use it on behalf of an organization, you confirm that you are authorized to act for that organization. If you do not agree, you should stop using the website.

2. Website information is not professional advice

Website content is general information only. It is not accounting, audit, investment, legal, tax, employment, regulatory or other professional advice and must not be treated as a substitute for advice based on your facts and jurisdiction. Laws, standards and commercial circumstances change, and website material may not be complete, current or suitable for your purpose.

You remain responsible for decisions, filings, approvals, records and actions taken in reliance on public content. No professional duty of care arises merely because you visit the website, download material or contact us.

3. Enquiries, proposals and service agreements

A contact-form submission, meeting request, estimate, discussion or proposal is not acceptance of an engagement unless BGB-360 expressly confirms it in a written agreement. The applicable engagement letter, proposal, statement of work, data-processing agreement and any service-specific terms will define scope, fees, responsibilities, deliverables, confidentiality, data protection, intellectual property, liability, duration and termination.

If these Website Terms conflict with a signed service agreement, the signed agreement prevails for that engagement. Mandatory law always prevails over any inconsistent term.

4. Professional and regulated-service boundaries

References to accounting, audit preparation, tax support, compliance, recruitment, education or legal and regulatory matters do not represent that BGB-360 performs a statutory audit, reserved legal service, licensed investment activity or any other regulated function unless that activity is expressly agreed and BGB-360 or the relevant delivery professional is lawfully authorized to perform it. Clients retain responsibility for statutory submissions, management decisions and approvals except where a written agreement and applicable law state otherwise.

5. Acceptable use

You may use the website only for lawful, legitimate purposes. You must not:

  • violate applicable law, another person’s rights or these Terms;
  • attempt to gain unauthorized access to an account, server, network, file or security control;
  • introduce malware, harmful code, automated attacks, excessive traffic or other interference;
  • scrape, harvest or systematically extract content or personal data except as permitted by law or written authorization;
  • impersonate another person, misrepresent authority or submit false, unlawful, defamatory or infringing material;
  • use website content to train or supply an automated or artificial-intelligence system without written permission where permission is legally required; or
  • remove copyright, trade mark or ownership notices.

We may restrict or block access when reasonably necessary to protect the website, users, BGB-360 or third parties, investigate misuse, comply with law or enforce these Terms.

6. Information and files you submit

You confirm that information you submit is accurate to the best of your knowledge, that you have authority to provide it and that its use for the stated purpose will not violate law or third-party rights. Do not send passwords, full payment-card details, government identity documents, health records, special-category personal data, privileged material or other highly sensitive information through the public contact form unless we have requested it and provided an appropriate secure method.

Personal data and confidential business information are handled according to our Privacy Policy and, where applicable, a confidentiality or service agreement.

7. Intellectual property and permitted use

The website and its text, design, graphics, branding, logos, photographs, video, downloads, software and other content are owned by or licensed to BGB-360 and are protected by applicable intellectual-property laws. BGB-360 grants you a limited, revocable, non-exclusive and non-transferable permission to view the public website and download material expressly made available for personal or internal business evaluation.

You may not reproduce, republish, sell, license, modify, distribute, frame or commercially exploit website content without prior written permission, except where mandatory law permits the use. Third-party names and marks remain the property of their respective owners.

8. Confidentiality

Public website content is not confidential. Information exchanged during an enquiry may, however, be commercially sensitive. Each party should protect non-public information received from the other and use it only to evaluate or perform the proposed relationship. More detailed obligations may be stated in a nondisclosure agreement or engagement letter. Nothing in these Terms requires disclosure of privileged, regulated or security-sensitive information.

9. Third-party websites and services

The website may link to third-party websites, social networks, platforms, payment services or resources. A link does not mean that BGB-360 controls, guarantees or endorses the third party. The third party’s own terms and privacy notice apply, and you should review them before use. We are not responsible for third-party availability, security, content or independent acts to the extent permitted by law.

10. Website availability and security

We aim to keep the website useful and reasonably secure, but do not promise uninterrupted, error-free or vulnerability-free operation. We may suspend, withdraw, restrict or change any public feature for maintenance, security, legal or business reasons. You are responsible for using appropriate device security, backups and network protection.

11. Accuracy, warranties and liability

The website and public content are provided on an “as available” basis. To the extent permitted by law, BGB-360 excludes warranties that are not expressly stated, including implied warranties concerning accuracy, completeness, fitness for a particular purpose and non-infringement.

BGB-360 is not liable for losses caused solely by reliance on general website information, temporary unavailability, unauthorized third-party activity or a third-party website where exclusion is lawful. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, fraudulent misrepresentation, wilful misconduct, gross negligence where applicable, or death or personal injury caused by negligence where such limitation is prohibited.

Liability relating to a professional service is governed by its signed agreement and mandatory law, not by this website clause.

12. Consumer rights

Nothing in these Terms removes a mandatory right available to a consumer under applicable law. If BGB-360 offers a paid distance service to a consumer, legally required pre-contract information, price and payment terms, cancellation rights, complaint information and service-specific conditions will be provided before the consumer is bound. A consumer’s statutory rights prevail over any inconsistent provision in these Terms.

13. Education initiative and future eBGB Portal

The eBGB Educational Portal is under development. Website descriptions explain its intended purpose and do not promise that registration, matching, payment, teaching or learning functionality is currently available. Before launch, portal-specific terms, privacy information, safeguarding rules, acceptable-use standards, educator and learner conditions, payment or cancellation provisions and age-appropriate controls will be published as applicable. These Website Terms do not by themselves govern a future portal account or transaction.

14. Changes to the website and these Terms

We may update the public website and these Terms to reflect service, operational, security or legal changes. The revised version will state its effective date. Changes apply prospectively from publication unless law requires another form of notice or consent. Material changes will not retrospectively alter an existing signed service agreement.

15. Severability, waiver and assignment

If a provision is found unlawful or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue to apply. A failure to enforce a provision is not a waiver. You may not assign rights under these Terms without our written consent; BGB-360 may transfer them as part of a legitimate reorganization or transfer of the website, subject to applicable law and without reducing mandatory user rights.

16. Governing law and disputes

These Website Terms are governed by Norwegian law, without prejudice to mandatory protections that apply in the country where a consumer habitually resides. The parties should first attempt to resolve a concern in good faith by contacting BGB-360. Subject to mandatory consumer jurisdiction rules, disputes concerning the public website are submitted to the competent courts of Norway.

Business clients and professional engagements may be subject to a different governing-law, jurisdiction or dispute-resolution clause in the signed service agreement.
